Following is my observation from my last H1B extension from Vermont.
You should be concerned if the extension is not approved before the expiry of the current H1B/I-94. Even if you apply months in advance, USCIS won't approve it till you are near your "old I-94" expiry date.
My H1B has already expired. My only proof of H1B is the receipt of H1B renewal application.

We got our receipts today. Mailed out the application on the 2nd - Reached NSC on the 3rd. Receipt numbers are SRC so my case got transferred to TSC.

You can quit after six months and then if taken to a court of law, you can tell the court that the employer refused to give you employment letter and under duress, you were forced to sign the letter. Your other option was to pack bags and leave the country if the employer did not give you the letter. And you can argue that the law lets you change employer after 180 days and hence you are not breaking the law. You can also argue that if the employer had not acted in bad faith by refusing to give you employment letter, you would have continued to work for the employer.
Ofcourse, you will need a very good lawyer if you want to fight the case on moral grounds (because it may be more expensive to fight the case than just pay the amount agreed to in the letter).

Hi,
My employer filed my wife's and my EAD paper based application on Jul 25, 2008 (TSC Received Date). But I still haven't received the Receipt notices for the same.
Generally how long does take to get the receipt notices?
Please let me know if any has filed around same date and received the receipts?

Ask your company's lawyer if the checks are cashed yet, if yes try to get the receipt # from the back of the check. When my first EAD was filed last year, our corporate lawyer had sent me image of back of the check.

I don't find anything wrong with that, there are more important social issues than spending time on greencard seeker forums......Atleast 1 attorney who explained it elaborately was Ron Gotcher, you can check on his website for that info...

If someone is from USA and they go to your country and live there for five years; they do not have historical context of why things are done the way they are done; no matter how long they research it.
We'll see when statistics come out. Which lawyers by the way say their interpretation is 180 degrees different?
How much visas did India get for the period October 1, 2004 to September 2005 (off the top of my head it was 50,000)
From October 2005 to September 2006 (it was around 10,500)
For the period October 2006 to September 2007 (someone want tofind it; it was more then 7%)
October 2007 to September 2008 (to be determined)

Once again a bureaucrat miscalculated the power hidden behind a peaceful protest. Now the power behind flowers is becoming a media mainstream story. NY Times, Washington Post, Reuters, Yahoo News are a few to name. Bollywood, has recently issued a statement providing its full support to Immigration Voice, the non profit organization behind the flower campaign.
An American way of fighting injustice "A law suit" is on its way, the usual rallies and demonstrations are about to begin. However, in America, its first time after Martin Luther King Jr., that someone has tried to apply Gandhi's way to fight injustice. It is yet not clear that what would be the outcome of this campaign, but there are rumours that USCIS is already discussing internally to reverse the discriminatory decision which resulted in this flower campaign causing enough embarrassement to them.
Its amazing to witness that 60 years after Gandhi's demise, his ideology is still relevant. We are sure its gonna remain relevant till there are Lord Wavell's in this world. Wavell's can momentarily laugh thinking that unorganized immigrants are helpless, but when the peaceful protest will demonstrate its political power, they surely will realize what Gandhi and Gandhian ways are all about.

Hi guys,
it is very frustrating that most of the guys whi have filed between July 2nd -July 16 have been waiting either close to 90 or more than 90 days, just for the sake of the DAMN receipt notices.
I have been very patiently waiting for the past 84 days (as i filed mine on July16th) and I see that even folks who filed just during the Aug 10th period are also getting their notices and getting their FP done.
DAMN with USCIS sorting order, as those morons could not even implement a FIFO manner, if they had followed, we would have had our receipts long back.
Once again, HELL with these stupid receipting process.
Hope atleast some of you can understand the pain in the whole friggin process.

Got receipt notice for I-485/AP/EAD/ from USCIS today (8/30/2007). My package was delivered to Nebraska center on July/27/2007. Notice date is August 21st, 2007. My priority date is Dec/23rd/2003.

I also got a lud on my I-140 on 27th of july 2008. It is an approved I-140.

7% quota based on national origin is based on law but it is clearly a biased and outdated law. It is beyond my comprehension why should we scared of initiating a litigation against the US government when it is clearly involved in blatant discrimination. The HSMP rules were challenged successfully by Indian high skilled workers in UK, why can't we do the same over here? I pledge to donate USD 200 for a lawsuit if such an action is initiated.

This country has opened its doors with a warm smile and a big heart for every hard working, highly-skilled legal immigrant who has one common thing more than anything else with every American � the American dream. Andy Grove of Intel, Sergey Brin of Google, Vinodh Khosla of Sun Microsystems are excellent examples of people who migrated to the US for higher education and then went on to found billion-dollar companies that employs thousands of Americans.
Everyday pressures at work, paying for mortgage, taking care of children are challenges that every working American goes through. But little is known about the silent pain and anxiety of high-skilled, tax-paying, law-abiding doctors, engineers and scientists who have to constantly keep track of their position in the "queue" to obtain their permanent residency status, more commonly the 'green card', as a first step towards calling America their home. Sometimes, the wait in the line can last as long as ten years. The wait comes with several restrictions like being bound to the particular job position with the sponsoring employer for as many years, foregoing promotions and inability to change jobs at will � work conditions unimaginable for an average American employee.
Sometimes the position in the long queue moves forward, when even a small movement causing immense joy and anticipation among the employees while sometimes the position moves backwards causing the employee to endure further pain. Historically the US government has opened the doors for the final stage of the green card application (where the applicant can adjust or change their status from any current non-immigrant status to a permanent resident status) every 3 years or so for a small window of time that typically lasts 30 -60 days. On June 13 th 2007 when the US government announced that July 2nd 2007 was the beginning of the one such window of time, the news sent thousands of prospective applicants into a tizzy mixed with relief, anticipation and joy. Many spent thousands of dollars in preparing required documentation, lawyer fee and canceling travel arrangements, to get their applications in on the first day itself.
Alas! With a hitherto unprecedented action, on the morning of July 2nd 2007, the same US government agency, with a terse and nondescript press release went back on its promise and slammed its door shut for any green card application. This action is clearly condemnable, unacceptable and unfair to thousands of high-skilled employees who contribute positively towards strengthening the US economy. Many feel wounded at the inhumane treatment in the hands of US immigration department and are contemplating migrating back to their homeland or to more immigrant friendly countries. However, a strong majority still trusts the US government to implement meaningful reforms specifically targeting legal immigrants while they continue to endure untold sufferings.

It is not his lunch. We should not see all this as a zero sum game. We all ought to learn not to get dragged into meaningless Eb2 v/s Eb3 fight. It doesn't help anyone. Some of us in IV core had the opportunity to see this situation very closely and witness how it plays out in Washington. No matter who says/starts Eb2 v/s Eb3 fight, you will not get any different response from IV.
Our position and work on this situation is very clear. We are all in this together and we should all help each other out instead of pulling each other down. This is the only way to fix the problem.

We have received reports that Sen. Cornyn will be introducing a bill called the SKIL (Securing Knowledge Innovation and Leadership) bill on May 1st 2006. As can be guessed from the title, this bill has lots of pro-legal immigration clauses. We will make the details that we have received public once we get the permission to do so.
Though Immigration Voice is currently focussing on the Comprehensive Immigration Bill as that is hot right now, we are also closely following the PACE and SKIL bills to try and ensure that high-skilled legal immigrants can make the best of it.
